SRINAGAR, NOV 01 : High Court today vide it’s order dated 29/10/18 has sent back the original record of trial court to CJM, Kathua in a criminal revision filed by the state of J&K, this order of high court has come as a major relief for juvenile Shubam Khajuria who is an alleged accused in the infamous Rassana rape and murder case.

 

The juvenile is facing trial before CJM, Kathua and now because of the passing of above mentioned order the court below will commence with trial in FIR no 10/2018.

 

High Court also observed that the criminal revision will be finally heard after 3 weeks. At the start of the proceedings Asheesh Singh Kotwal advocate for the juvenile /accused forcefully raised a preliminary objection with regard to the maintainability of the petition in view of Supreme Court orderย  which barred courts from entertaining any petition pertaining to Rassana Caseย  as the highest court is monitoring the matter.

 

The state of J&K was represented by H S Siddqui and respondent was represented by Asheesh Singh Kotwal. However high court has directed the court below to make available scanned copy of original record.
