‘Not believable’ that such an important file can get missing: JK Govt  ‘Reports about missing file are unconfirmed’

Srinagar: Following reports of the file containing legal opinion on Article 35A having missed from North Block’s high-security vaults, the State government Sunday said that it is “not believable” that such an important file can get missing.

“Reports are not believable as the file about 35 A is very important and such files are not kept in only one single department. In case, the file is missing then the copy of the file and the records it carries will be available in the office of the President of India,” sources in the Law Department told KNS.

Sources told KNS that “there is nothing worrying” about the Article 35A or the file because the file will be available in the offices of Home, Law Ministry and the President of India”

English daily, The Telegraph reported on Sunday that the 1954 file containing the then Attorney General’s opinion justifying the insertion of Article 35A into the Constitution that year through a presidential order rather than a constitutional amendment has gone missing gone missing from Home Ministry’s legal and administrative records section of North Block in New Delhi during Swachh Bharat campaign between June 22 and 26 in 2015 when it weeded out hundreds of old files.

The Supreme Court is hearing a petition by a Sangh-backed NGO that has sought the scrapping of the article, which bars outsiders from acquiring land or jobs in Jammu and Kashmir, on the ground that it was introduced without Parliament’s approval. (KNS)
